1. Acceptance and eligibility
These Terms of Service and End User License Agreement, together called the Terms, form a binding agreement between you and longefy.app, referred to as we, us, or our. By downloading, accessing, purchasing, or using Longefy, you agree to these Terms. If you do not agree, do not use the app.
You must be at least 18 years old and legally able to enter into this agreement. Longefy is not directed to children.
2. License and acceptable use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use Longefy on Apple devices you own or control, solely for personal and non-commercial purposes and as permitted by Apple usage rules.
You may not
- Copy, modify, distribute, sell, lease, sublicense, or create derivative works from the app.
- Reverse engineer, decompile, disassemble, attempt to derive source code, or bypass security or technical controls, except where the law expressly permits it.
- Use the app unlawfully, fraudulently, harmfully, or in a way that interferes with another person or the app.
- Misrepresent results, misuse content, introduce malicious code, or access the app through unauthorized means.
3. Intellectual property
Longefy, its logo, visual identity, content, software, features, and associated intellectual property are owned by longefy.app or its licensors. Except for the limited license above, no rights are transferred to you. Apple and Apple Health are trademarks or services of Apple Inc.
4. Subscriptions, free trial, and billing
Longefy offers a 3-day free trial followed by an auto-renewable subscription. Available plans include Weekly at 6.99 USD and Yearly at 59.99 USD. Prices may vary by region and may change with notice as permitted by applicable law and Apple policies.
Payment is charged to your Apple Account at confirmation of purchase. After the free trial, your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period. Any unused portion of a free trial is forfeited when you purchase a subscription.
Manage or cancel your subscription in your Apple Account settings. On iPhone or iPad, open Settings, tap your name, tap Subscriptions, select Longefy, then follow the available options. Deleting the app does not cancel a subscription. Refund requests are handled by Apple under its policies.
5. Apple terms and third-party beneficiary
If no custom end user license agreement governs your use of Longefy, Apple's Standard End User License Agreement applies. You can review it at apple.com/legal/internet-services/itunes/dev/stdeula.
These Terms are between you and longefy.app, not Apple. Apple is not responsible for Longefy, its content, maintenance, support, warranties, claims, or legal compliance. To the extent permitted by law, Apple has no warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance. 6. Wellness and medical disclaimer
Longefy provides general wellness and educational information, suggestions, and estimates only. It is not a medical device. It does not provide medical advice, diagnose any condition, or treat, cure, or prevent any disease. It is not a substitute for advice, diagnosis, or treatment from a qualified healthcare professional.
Heart-rate readings produced using a phone or tablet camera are estimates and may be inaccurate because of movement, lighting, device position, skin characteristics, device limitations, or other factors. Healthy-aging estimates, trends, Glow Studio suggestions, and coach content may also be incomplete or inaccurate. Do not make medical decisions based on the app.
Consult a qualified healthcare professional about symptoms, conditions, medications, or other medical concerns. Never delay or disregard professional care because of information in Longefy. In an emergency, call your local emergency services immediately.
7. Assumption of risk and no guarantee of results
You acknowledge that you use Longefy and act on any wellness suggestions at your own risk. You remain responsible for your decisions, activities, and wellbeing. We do not guarantee any health, wellness, appearance, lifestyle, or other result. We do not guarantee that measurements, estimates, suggestions, trends, or other content will be accurate, complete, current, or suitable for you.
8. Disclaimer of warranties and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LONGEFY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, longefy.app AND ITS OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR HEALTH OUTCOMES, ARISING FROM OR RELATED TO THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO LONGEFY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR LONGEFY DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR 50 USD. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.
9. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless longefy.app and its officers, employees, and agents from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your misuse of Longefy, unlawful conduct, or violation of these Terms.
10. Termination
You may stop using Longefy at any time. We may suspend or terminate your access if you materially violate these Terms, misuse the app, create a security or legal risk, or if we discontinue the app. Where reasonable, we will provide notice. Upon termination, your license ends and you must stop using the app. Provisions that by their nature should survive will remain in effect, including ownership, disclaimers, liability limits, indemnification, and dispute terms. Termination does not automatically cancel an Apple subscription.
11. Governing law and disputes
These Terms are governed by the laws of [GOVERNING_LAW_JURISDICTION], without regard to conflict-of-law rules. Courts located in [GOVERNING_LAW_JURISDICTION] will have exclusive jurisdiction and venue, unless applicable consumer law requires otherwise.
Informal resolution
Before filing a formal claim, contact us at [CONTACT_EMAIL] with your name, a description of the dispute, and the relief requested. The parties will attempt in good faith to resolve the matter informally for at least 30 days.
Optional clause, jurisdiction-dependent: binding arbitration and class-action waiver
If valid and included following legal review, unresolved disputes will be resolved by individual binding arbitration rather than in court, except that either party may bring an eligible claim in small claims court or seek urgent injunctive relief. You and longefy.app waive any right to a jury trial and agree to bring claims only in an individual capacity, not as a plaintiff or member in any class, collective, consolidated, or representative action. This paragraph may not apply where prohibited by law.
12. Changes, severability, entire agreement, and contact
We may update these Terms. We will provide notice of material changes through the app, by email, or by another reasonable method. Changes take effect on the stated effective date. Continued use after that date means you accept the updated Terms, where permitted by law.
If any provision is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and any applicable Apple terms are the entire agreement regarding Longefy and replace prior agreements on the same subject.
